Q: Are ventless or vent free gas fireplaces legal in the 5 boroughs of NYC?
A: No. We are asked this question many times a day. As of now these units do not comply with MEA approval and are therefore illegal. Most people are misinformed by other dealers that sell these fireplaces but we will not sell them as they are not an approved product.

Q: What is MEA# and is it required in the 5 boroughs?
A: Established in 1969, the Materials and Equipment Acceptance (MEA) Division was created under Department Rule 1-01 to implement the Code requirement and ensure that certain permanent building materials and equipment meet the minimum national standards required by the Building Code. The unit also reviews the qualifications of testing laboratories and testing services for acceptance by the Department. It is the responsibility of the manufacturer to obtain MEA acceptance for his or her product. All manufacturers that receive product acceptance from MEA are given an MEA number for the product and provided a copy of the report (also called resolution), which lists the model number(s) and describes the material, assembly or equipment and any conditions of the acceptance.

A: Yes. New York City Buildings Code requires that a licensed architect must file the alterations to the home and a licensed plumber must file the necessary permits to have gas lines run.
